UGC Terms of Use

Article 1 Purpose of User Generated Content (UGC) Agreement

1. These terms define the basic matters such as rights, obligations, and other necessary items between the Company and users regarding UGC.
2. Users must comply with these terms, the End User License Agreement (EULA), Terms of Service, Operating Policy, Privacy Policy (collectively referred to as "Company Regulations"), and relevant laws such as the Copyright Act when creating and using UGC.

Article 2 Definition of UGC

1. User Generated Content (UGC) refers to any and all content created by users in connection with the service.
2. UGC includes communications including chat text uploaded or transmitted by users through the client or service, images, sounds, and all materials and information, as well as text, documents, drawings, images, videos (streaming, broadcast videos, etc.), music, acoustics, voice, effects, applications, or materials and information consisting of combinations thereof directly produced by users in connection with bulletin boards or services.

Article 3 Creation of UGC

1. The Company permits and actively encourages users to create UGC. However, users must ensure that UGC does not violate the following matters:
2. It must not contradict laws, Company Regulations, and other public order and morals.
3. It must not infringe on intellectual property rights, including copyrights, or other rights of third parties.
4. It must not defame the Company or other third parties.
5. It must not contain or promote content that is false, manipulated, fraudulent, deceptive, illegal, obscene, threatening, defamatory, offensive, or contrary to the Company's interests.

Article 4 Use of UGC

1. The Company may use, modify, edit, and otherwise transform UGC (including reproduction, performance, public transmission, exhibition, distribution, rental, and creation of derivative works, available in any form without restrictions on the period or region of use) free of charge.
2. However, if the Company intends to sell, rent, or transfer UGC to a third party, it shall separately consult with the user in advance via telephone, fax, email, etc.
3. To the extent that a member allows access to and use of their UGC by other members, the member agrees to grant all members of Hopy the right to access and use their UGC without additional notice, attribution, or compensation, and to transmit and distribute it within a range that does not violate Hopy's policies.
4. If a member posts UGC they directly produced on other platforms or channels including communities, it must be freely viewable, accessible, and shareable by other users. When using UGC, no restrictions or obligations, such as requiring other users to pay additional costs or obtain approval, can be established within a range that does not violate relevant policies.

Article 5 Ownership of Rights

1. All rights including copyrights and other intellectual property rights of the service belong to the Company, and the Company grants the member the authority to use them in accordance with these terms.

2. Hopy automatically holds the right and license to use, reproduce, modify, adapt, publish, translate, sublicense, produce derivative works, and distribute the UGC generated by members to the maximum extent permitted by relevant laws. This right held by Hopy is an irrevocable non-exclusive right, not limited to a region, and no separate usage fee is paid. Members agree that these rights will be used for all purposes, including commercial purposes, without separate compensation to the member. Furthermore, members agree to waive moral rights or similar rights to the UGC they produce and not to claim rights thereto.

Article 6 Company Rights and Indemnification

1. The Company may restrict a user's service use, UGC creation, and use, or delete the UGC if it is notified or recognizes that the UGC infringes on the rights of the Company or a third party, or if inappropriate content is identified according to the terms.

2. If a legal dispute or related damage occurs between the Company or its employees and a third party because the UGC infringes on the rights of a third party, the user shall indemnify the Company or its employees at their own expense and responsibility, unless there is intentional or gross negligence on the part of the Company.
